The right to use products and/or services by Database Innovations is personal to you and is not transferable to any other person or company

Database Innovations reserves the right to change the terms and conditions, or to impose new terms and conditions. Such modifications or additions shall be effective immediately upon notice to each client.  Notice may be given by any reasonable means including, but not limited to, posting a revised version of this Agreement on the Internet or notification by electronic mail. Any use of the products or services of Database Innovations after such notice shall conclusively be deemed to constitute acceptance by you of such modifications, additions, or deletions. You have the responsibility to periodically review the posted terms and conditions to be aware of such revisions.

1. Use of Database Innovations material

Database Innovations authorizes you to view, copy, and print a single copy of material from the Database Innovations website (www.databaseinnovations.com.au) solely for your personal, non-commercial use. Special rules may apply to the use of certain software and other items provided.

As a client, you agree to use the services offered by Database Innovations in a manner consistent with all applicable local, state and federal laws and regulations. No material shall be stored or transmitted which infringes or violates the rights of others, which is unlawful, obscene, indecent or otherwise objectionable, threatening, defamatory, or invasive of privacy or publicity rights. Database Innovations prohibits conduct that might constitute a criminal offence, gives rise to civil liability or otherwise violates any law. Any activity that restricts or inhibits any other user from using the services of Database Innovations is also prohibited. Unless allowed by a written agreement, you may not post or transmit advertising or commercial solicitation on the Database Innovations website.

The contents of the Database Innovations website, such as text, graphics, images and other data ("data"), are protected by Australian and foreign copyright and trademark laws. Unauthorized use of the data may violate copyright, trademark, and other laws. You must retain all copyright and other proprietary notices contained in the original data on any copy you make of the data. You may not sell or modify the data or reproduce, display, publicly perform, distribute, or otherwise use the data in any way for any public or commercial purpose. The use of the data on any other website or in a networked computer environment for any purpose is prohibited.

If you violate any of the terms or conditions, your permission to use the data automatically terminates and you must immediately destroy any copies you have made of the data

2. Database Innovations Client Warranty & Indemnity

Clients (Website Design and Custom Software Design) upon and by lodging material with Database Innovations for use on their website and/or custom software or authorizing or approving the publication of any material in this instance or at any time in the future HEREBY INDEMNIFY Database Innovations, its servants and agents against all actions, claims or proceedings of any kind whatsoever arising from the publication of that material and without limiting the generality of the foregoing INDEMNIFY each of them in relation to any breach of copyright, infringement of trademarks or names of publication titles, breach of unfair competition or trade practices legislation, infringement of royalties or violation of rights or privacy or defamation or slander action AND WARRANT that the material complies with all relevant laws and regulations and that publication will not give rise to any rights against or liability of Database Innovations, its servants or agents and in particular that nothing therein is capable of being misleading or deceptive or otherwise in breach of the Trade Practices Act, the Fair Trading Act or other like legislation.  Whilst every effort has been made to ensure the accuracy of the information, Database Innovations assumes no responsibility for errors or omissions or for any consequences of reliance on the data / text / images.  Database Innovations uses the text / data / images provided from clients but gives no warranty and makes no representation as to the truth, accuracy or sufficiency of any text /data / images or any description, photograph or statement therein.  Database Innovations accepts no liability for any loss suffered by any person as a consequence of reliance on any text / data / image or other material supplied by clients for use on their website.  Database Innovations reserves the right to refuse text / data / images supplied by clients for use on their website and / or custom software.

 3. Limitation of Liability and Disclaimer of Consequential Damages.
Under no circumstances, including negligence, shall Database Innovations be liable for any special or consequential damages that result from the use of, or the inability to use, the Database Innovations website and/or the website and email hosting facilities and any data or related documentation including custom Database Software created as per clients direction.  Even if a Database Innovations staff member has been so advised of the possibility of such damages.  In no event shall Database Innovations total liability to you for all damages, losses and causes of action exceed $100.

The Database Innovations website, written material and Custom Database Software may contain inaccuracies or typographical errors. Database Innovations makes no representations about the accuracy, reliability, completeness, or timeliness of Database Innovations products and services including the Database Innovations website or about the results to be obtained from using the Database Innovations website or Custom Database Software.  Use of the website and the data is at your own risk. Changes are periodically made to the website, and may be made at any time.

Database Innovations does not warrant that its website and/or website and email hosting facility will operate error-free or that the website and its server are free of computer viruses and other harmful goods or conditions. If your use of the Database Innovations website and / or hosting facility results in the need for servicing or replacing equipment or data, Database Innovations is not responsible for those costs.

The Database Innovations website, data and custom database software are provided on an 'as is' basis without any warranties of any kind Database Innovations and its suppliers, to the fullest extent permitted by law, disclaim all warranties, including the warranty of merchantability, non-infringement of third parties rights, and the warranty of fitness for particular purpose. Database Innovations and its suppliers make no warranties about the accuracy, reliability, completeness, or timeliness of the material, services, software text, graphics, and links.

These links are provided solely as a convenience to you and not as an endorsement by Database Innovations of the contents on such third-party Web sites.
